RESOLUTION 19-3142 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF A QUIT CLAIM <br />DEED FOR THE CONVEYANCE OF THE LEGACY PARK LIFT STATION, PARCEL <br />ID #10-21-30-5RU-0000-004A, TO SOUTH SEMINOLE NORTH ORANGE COUNTY <br />WASTEWATER TRANSMISSION AUTHOR TY; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry is a member of the South Seminole North Orange <br />County Wastewater Transmission Authority (SSNOCWTA) which is used to transport a portion of <br />the City's wastewater to the City of Orlando's Iron Bridge Wastewater Facility for treatment and <br />disposal; and <br />WHEREAS, the Enabling Act that created SSNOCWTA in 1978 requires that all lift <br />stations pumps wastewater into its transmission system be owned by SSNOCWTA; and <br />WHEREAS, through title research it was discovered that the Legacy Park Lift Station <br />owned by the City of Casselberry is supposed to be owned by SSNOCWTA; and <br />WHEREAS,a Quit Claim Deed is needed to convey the Legacy Park Lift Station, Parcel ID #10- <br />21-30-5RU-0000-004A, to SSNOCWTA to fulfill the requirements of the Enabling Act; and <br />WHEREAS, City staff has reviewed the Quit Claim Deed and finds it sufficient to meet the <br />needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby authorizes the <br />execution of the Quit Claim Deed for the conveyance of the Legacy Park Lift Station to <br />SSNOCWTA and authorizes the Mayor to execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
