<br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
<br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING
<br />THE CLOSURE, VACATION, AND ABANDONMENT OF
<br />EASEMENT RIGHTS ON LAND WITH PARCEL
<br />IDENTIFICATION NUMBER 09-21-30-5BM-OA00-OOP1, AS
<br />RECORDED IN OFFICIAL RECORD BOOK 8334, PAGE 611,
<br />PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA;
<br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND
<br />EFFECTIVE DATE.
<br />WHEREAS, a drainage easement (herein described as the "Easement") was established by the
<br />City of Casselberry (City) on a tract of land with parcel identification number 09-21-30-5BM-OA00-OOP 1,
<br />included in a Quit Claim Deed dated September 4, 2014, and recorded in Official Record Book 8334,
<br />Page 610 (attached Exhibit "A").
<br />WHEREAS, on August 20, 2019, a Petition to Close, Vacate, and Abandon Easement was
<br />submitted to the City Commission of the City of Casselberry, Florida, to close, vacate, and abandon the
<br />Easement rights to remove the following language, "The Grantor Hereby Retains Easement Rights across
<br />the property described Herein for drainage purposes" (see Exhibit "B").
<br />WHEREAS, the Easement in favor of the City of Casselberry as the Grantor was included in the
<br />legal description of the Quit Claim Deed as, "That certain Park lying in Block A of Sportsman's Paradise,
<br />according to the plat thereof, as recorded in Plat Book 8, Pages 12 and 13, of the Public Records of
<br />Seminole County, Florida, lying south of and adjacent to Lots 10, 11, and 12 of said Block A and extending
<br />to the northerly shore lines of Lake Emily, Lake Cecile and Lake Annette. The Grantor Hereby Retains
<br />Easement Rights across the property described Herein for drainage purposes."
<br />WHEREAS, the City Commission finds that closing, vacating, and abandoning the Easement,
<br />including renouncing any public rights, will not present a detriment to either the City of Casselberry,
<br />Florida, or the public.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
<br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS:
<br />SECTION I. The City Commission of the City of Casselberry hereby approves this Resolution
<br />and does hereby close, vacate, and abandon the easement rights on the Easement on land with parcel
<br />identification number 09-21-30-5BM-OA00-OOP1 included in Quit Claim Deed (Exhibit "A"), dated
<br />September 4, 2014, and recorded in Official Record Book 8334, Page 610, and authorizes the Mayor to
<br />sign this Resolution on behalf of the City Commission.
<br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the
<br />provisions of this Resolution are hereby repealed.
<br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be
<br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or
<br />effect of any other Section or part of this Resolution.
