RESOLUTION 19-3128 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, TERMINATING THE DECLARATION OF <br />A STATE OF PUBLIC EMERGENCY PREVIOUSLY APPROVED AND <br />EXTENDED INDEFINITELY BY RESOLUTION 19-3126; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, Governor Ron DeSantis issued Executive Order 19-189 on August 28, <br />2019 declaring a state of public emergency for Seminole County due to the expected strength <br />and forecast models for Hurricane Dorian; and <br />WHEREAS, the City Manager of the City of Casselberry is authorized to declare a state <br />of public emergency as provided by Section 30-7 of the City Code of Ordinances; and <br />WHEREAS, a public state of weather emergency as provided by Section 30-10 of the <br />City Code of Ordinances was declared by the City Manager to be effective at 6:00 p.m. on <br />Sunday, September 1, 2019 due to the anticipated impacts of Hurricane Dorian on the City of <br />Casselberry; <br />WHEREAS, the declaration of a public state of weather emergency is required for <br />activation of emergency plans adopted by the City; and <br />WHEREAS, on September 1, 2019, the City Commission confirmed the emergency <br />declaration made by the City Manager and further extended the declaration of state of public <br />emergency indefinitely via Resolution 19-3126 ; and <br />WHEREAS, on September 3 and 4, 2019, the City of Casselberry and Seminole County <br />in total were extremely fortunate to only experience minimal impacts from Hurricane Dorian due <br />to the path staying offshore therefore not requiring any recovery efforts from the storm. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. The City Commission hereby terminates the Declaration of State of Public <br />Emergency which commenced on September 1, 2019 at 6:00 p.m. <br />SECTION 2. Conflicts. All prior Resolutions or parts of Resolutions in conflict <br />herewith are hereby repealed to the extent of the conflict. <br />SECTION 3. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION 4. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
