RESOLUTION 19-3126 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, CONFIRMING THE DECLARATION OF A <br />STATE OF EMERGENCY AND ALL EMERGENCY REGULATIONS <br />ACTIVATED BY THE CITY MANAGER AS PROVIDED BY CHAPTER <br />30 OF THE CASSELBERRY CODE OF ORDINANCES; PROVIDING <br />FOR AN EXTENSION OF THE 72 -HOUR TIME LIMIT FOR SAID <br />STATE OF EMERGENCY UNTIL TERMINATED BY THE CITY <br />COMMISSION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, Governor Ron DeSantis issued Executive Order 19-189 on August 28, <br />2019 declaring a state of emergency for Seminole County due to the expected strength and <br />forecast models for Hurricane Dorian; and <br />WHEREAS, the City Manager of the City of Casselberry is authorized to declare a state <br />of emergency as provided by Section 30-7 of the City Code of Ordinances; and <br />WHEREAS, a public state of weather emergency as provided by Section 30-10 of the <br />City Code of Ordinances was declared by the City Manager to be effective at 6:00 p.m. on <br />Sunday, September 1, 2019 due to the anticipated impacts of Hurricane Dorian on the City of <br />Casselberry and shall terminate at the end of a period of 72 consecutive hours, said termination <br />being at 6:00 p.m. on Wednesday, September 4, 2019; and <br />WHEREAS, the declaration of a public state of weather emergency is required for <br />activation of emergency plans adopted by the City; and <br />WHEREAS, Section 30-7(b) of the City Code of Ordinances requires that the City <br />Commission confirm the emergency declaration made by the City Manager; and <br />WHEREAS, Hurricane Dorian has the potential to create widespread disaster debris <br />throughout the City of Casselberry, which poses a significant and immediate threat to the health, <br />safety and welfare of the citizens of the City of Casselberry and the public at large; and <br />WHEREAS, pursuant to Executive Order 19-189, and Section 252.38(3)(a), Florida <br />Statutes, political subdivisions, such as the City of Casselberry, have the authority to exercise <br />certain powers and authority to safeguard the lives and property of its citizens and community; <br />and <br />WHEREAS, to ensure the protection of the public health, safety, and welfare of the <br />citizens, the City of Casselberry desires to timely and efficiently remove such vegetative and <br />other tree debris throughout the entire City; and <br />WHEREAS, Section 30-7(f) of the City Code of Ordinances requires the City <br />Commission to authorize a request to extend the emergency declaration beyond the 72 -hour time <br />limit. <br />
