RESOLUTION 19-3090 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF AMENDMENT #3 TO THE COOPERATIVE <br />AGREEMENT WITH THE UNITED STATES DEPARTMENT OF <br />AGRICULTURE NATURAL RESOURCES CONSERVATION SERVICE <br />FOR GEE CREEK AND HOWELL CREEK EROSION CONTROL FOR <br />ADDITIONAL FEDERAL FUNDING; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry experienced significant erosive damage within Gee <br />Creek and Howell Creek basins as a result of Hurricane Irma in September 2017; and <br />WHEREAS, the City Commission authorized City staff to submit an application to the <br />United States Department of Agriculture Natural Resources Conservation Service (USDA <br />NRCS) in an effort to obtain a grant to offset the costs associated with erosion control measures <br />in Gee Creek and Howell Creek basins worsened by Hurricane Irma; and <br />WHEREAS, on June 11, 2018, the City Commission approved a Cooperative Agreement <br />with the USDA NRCS in which the NRCS awarded the City funding to assist with the erosion <br />control in Gee Creek and Howell Creek basins; and <br />WHEREAS, said Agreement provides for a total amount of financial assistance not to <br />exceed $788,686.10 ($695,899.50 for construction and $92,786.60 for technical assistance), and <br />a required 25% construction funding match (or $231,966.50) from the City; and <br />WHEREAS, based on actual anticipated project costs, which will exceed the original <br />Agreement amount, City staff requested consideration from NRCS for additional federal funding <br />in the amount of $83,002.48, consisting of $55,556.17 in additional construction assistance and <br />$27,446.31 in additional technical assistance; and <br />WHEREAS, NRCS has provided a proposed Amendment to the Agreement to provide <br />the requested additional funding; and <br />WHEREAS, the proposed Amendment will require an additional City construction <br />funding match of $18,518.72, which is already budgeted and available for the project; and <br />WHEREAS, City staff has reviewed Amendment #3 to the Cooperative Agreement <br />submitted by the United States Department of Agriculture Natural Resources Conservation <br />Services and finds it favorable to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />
