RESOLUTION 16-2825 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF AN <br />AMENDED EXHIBIT "A" TO THE TRAFFIC SIGNAL MAINTENANCE <br />AND COMPENSATION AGREEMENT WITH THE FLORIDA <br />DEPARTMENT OF TRANSPORTATION; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, on June 8, 2015, the City Commission approved a Traffic Signal Maintenance <br />and Compensation Agreement with Florida Department of Transportation (FDOT) to receive <br />compensation for the maintenance of FDOT traffic signals within the City limits on U.S. Hwy. 17- <br />92 and State Road 436; and <br />WHEREAS, FDOT wishes to amend the previously approved agreement to include <br />additional compensation to the City of $304 to provide for the maintenance of a recently installed <br />"No Turn" blank -out sign at the intersection of Red Bug Lake Road and South Winter Park Drive, <br />near the SR 436/Red Bug Lake Road Interchange; and <br />WHEREAS, FDOT has provided an Amended Exhibit "A" to the Traffic Signal <br />Maintenance and Compensation Agreement which will increase the annual compensation payable <br />to the City from $33,440/year to $33,744/year for traffic signal maintenance; and <br />WHEREAS, Public Works Department staff has reviewed the Amended Exhibit "A" to the <br />Traffic Signal Maintenance and Compensation Agreement with FDOT and finds it favorable to <br />meet the needs of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves Amended <br />Exhibit "A" to the Traffic Signal Maintenance and Compensation Agreement with the Florida <br />Department of Transportation and authorizes the Mayor to execute said document on behalf of the <br />City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
