RESOLUTION 16-2820 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF CHANGE ORDER NO. 1 TO THE GUARANTEED MAXIMUM PRICE TO THE CONSTRUCTION MANAGER AT RISK SERVICES AGREEMENT WITH WHARTON SMITH, INC. FOR CONSTRUCTION OF THE LAKE CONCORD PARK AND TRIPLET LAKE DRIVE SIGNATURE STREET PROJECTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, on March 9, 2015, the City Commission approved the Construction Manager at Risk Services Agreement (CMRSA) with Wharton Smith, Inc. for the Lake Concord Park and Triplet Lake Drive Signature Street projects; and WHEREAS, the CMRSA, at the completion of plans for the Lake Concord Park and Triplet Lake Drive Signature Street projects, requires Wharton Smith to provide a guaranteed maximum price for construction the improvements associated with each project; and WHEREAS, Wharton Smith submitted a guaranteed maximum price proposal to construct the required Lake Concord Park project improvement in the amount of $7,324,162 and --a guaranteed maximum price proposal -to- construct -the required Triplet- Lake Drive Signature Street project improvement in the amount of $3,092,425; and WHEREAS, the City Commission approved the contract with Wharton Smith on September 28, 2015 through Resolution 15-2788; and WHEREAS, Change Order No.l is needed in the amount of $316,308.90 to provide additional services to mitigate contamination on the Lake Concord Park project; and WHEREAS, the City Manager has reviewed the agreement with Wharton Smith, Inc. and finds it favorable to the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves Change Order No. 1 to the agreement with Wharton Smith, Inc. for an amount not to exceed $316,308.90 for the Lake Concord Park project and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION HI. Severabilitv. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
