RESOLUTION 16-2842 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />APPROVING THE EXECUTION OF A STATE HIGHWAY <br />MAINTENANCE MEMORANDUM OF AGREEMENT CONTRACT <br />NO. ARY45 BETWEEN THE FLORIDA DEPARTMENT OF <br />TRANSPORTATION AND THE CITY OF CASSELBERRY; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, per an existing Memorandum of Agreement (MOA) between the City of <br />Casselberry and the Florida Department of Transportation (FDOT), the City of Casselberry has <br />provided routine and beautification right-of-way maintenance for portions of U.S. Highway 17-92 <br />and S.R. 436; and <br />WHEREAS, FDOT has provided financial compensation to the City for said right-of-way <br />maintenance services; and <br />WHEREAS, the existing MOA for said right-of-way maintenance services will expire on <br />April 30, 2016; and <br />WHEREAS, the City of Casselberry wishes to continue an active role in beautification and <br />maintenance of said right-of-ways; and <br />WHEREAS, FDOT has submitted a new State Highway Maintenance Memorandum of <br />Agreement for these two roadway right-of-ways in the reimbursable amount to the City of $132,000 <br />per year for three (3) consecutive years for a total amount of $396,000; and <br />WHEREAS, Public Works has reviewed the proposed FDOT State Highway Maintenance <br />Memorandum of Agreement, Contract No. ARY45, and finds it favorable to the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselbeny hereby approves the State <br />Highway Maintenance Memorandum of Agreement between the Florida Department of <br />Transportation and the City of Casselberry, Contract No. ARY45, and authorizes the Mayor to <br />execute said document(s) on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
