RESOLUTION 16 -2839 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, APPOINTING AND <br />AUTHORIZING THE EXECUTION OF AN AGREEMENT <br />WITH ROBIN G. DRAGE AS ALTERNATE SPECIAL <br />MAGISTRATE FOR CODE ENFORCEMENT PROCEEDINGS; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN <br />EFFECTIVE DATE. <br />WHEREAS, the City Commission of the City of Casselberry currently provides for <br />enforcement of its Code of Ordinances in Chapter 2, Article IV, Division 2, Code Enforcement <br />Board; and <br />WHEREAS, Ordinance 13 -1400 amended the Casselberry City Code to create an <br />alternative method of enforcement procedure through a Code Enforcement Special Magistrate <br />pursuant to Section 162.03(2), Florida Statutes; and <br />WHEREAS, the City Commission appointed both a primary and an alternate Special <br />Magistrate on February 24, 2014 via Resolutions 14 -2573 and 14 -2574, respectively: and <br />WHEREAS, due to the resignation of the alternate Special Magistrate, appointment of a <br />replacement is necessary; and <br />WHEREAS, Attorney Robin G. Drage had submitted her proposal for the original bid <br />opening and has confirmed she is willing to serve as the alternate Special Magistrate at her <br />proposed rate of $165 per hour; and <br />WHEREAS, the City's Procurement Administrator finds the proposal from Attorney <br />Drage acceptable to meet the needs of the City and recommends her appointment as alternate <br />Special Magistrate. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry, Florida hereby appoints <br />Robin G. Drage as the alternate Special Magistrate for Code Enforcement proceedings. <br />SECTION H. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION HI. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
