RESOLUTION 16 -2832 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF CHANGE ORDER NO. 2 TO THE AGREEMENT WITH WHARTON SMITH, INC. FOR CONSTRUCTION OF THE LAKE CONCORD PARK AND TRIPLET LAKE DRIVE SIGNATURE STREET PROJECTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, on March 9, 2015, the City Commission approved the Form of Agreement Between Owner and Constiuction Manager (Construction Manager at Risk Services Agreement) with Wharton Smith, Inc. for the Lake Concord Park and Triplet Lake Drive Signature Street projects; and WHEREAS, Wharton Smith submitted a Guaranteed Maximum Price (GMP) proposal to construct the required Lake Concord Park and the Triplet Lake Drive Signature Street project improvements in the amount of $10,416,587; and WHEREAS, the City Commission accepted the proposal and approved a GMP contract with Wharton Smith on September 28, 2015 through Resolution 15 -2788; and WHEREAS, the City Commission approved Change Order No. 1 on January 11, 2016 through Resolution 16 -2820 in the amount of $316,308.90 for additional services to mitigate soil contamination in the Lake Concord Park project area; and WHEREAS, Wharton Smith has submitted Change Order No. 2 in the amount of $10,608.02 to provide for re- routing conduit and fiber main connectivity within the existing Public Works Administration Building; and WHEREAS, City staff has reviewed the Wharton Smith proposal for Change Order No. 2 and finds it favorable to the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselber7y hereby approves Change Order No. 2 to the Agreement with Wharton Smith, Inc. for an amount not to exceed $10,608.02 for the Lake Concord Park project, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed.
