RESOLUTION 16 -2831 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, PROVIDING FOR AN <br />AMENDED MODEL HOME AGREEMENT BETWEEN THE <br />CITY OF CASSELBERRY AND PULTE HOMES <br />CORPORATION FOR THE RESERVE AT LEGACY PARK <br />SITE ON TRACT B OF THE LEGACY PARK PLANNED <br />DEVELOPMENT; PROVIDING FOR CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE. <br />WHEREAS, Pulte Homes Corporation is the owner of the property located within <br />Tract B of the Legacy Park Planned Development within the Seminola Boulevard Overlay <br />District; and <br />WHEREAS, the City Commission approved the site plan and the preliminary re- <br />plat for development of one hundred and twenty (120) Single Family and Garden Homes on <br />the described property; and <br />WHEREAS, Pulte Homes Corporation would like to construct a model home center <br />prior to obtaining a final plat for the described property; and <br />WHEREAS, the City Commission approved the Model Home Agreement with Pulte <br />Homes through Resolution 16 -2816 on January 11, 2016; and <br />WHEREAS, the location of the model homes provided on Exhibit B of the Agreement <br />has been amended; and <br />WHEREAS, the remaining conditions related to the use and operation of the model <br />home center are unchanged from the guidelines previously approved within the Model Home <br />Agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF <br />THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. Pursuant to F.S Chapter 166.041 `Procedure for adoption of ordinances <br />and resolutions' and Section 2 -56 `Resolutions' of the Unified Land Development <br />Regulations, the City Commission approves the Amended Model Home Agreement with <br />Pulte Homes Corporation, attached as Attachment A, and authorizes the Mayor to execute <br />said document on behalf of the City. <br />SECTION 2. Conflicts. All resolutions or parts of resolutions in conflict with any <br />of the provisions of this Resolution are hereby repealed. <br />SECTION 3. Severability. If any section or portion of a section of this Resolution <br />proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or <br />
