RESOLUTION 14 -2561 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF AMENDMENT #4 TO THE GENERAL CONSTRUCTION <br />MANAGER AT RISK FOR PROJECTS LESS THAN $2 MILLION <br />AGREEMENT WITH WHARTON- SMITH, INC. FOR CONSTRUCTION <br />OF THE SOUTH WATER TREATMENT PLANT GRANULAR <br />ACTIVATED CARBON TREATMENT ADDITION; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the potable water system surrounding the South Water Treatment Plant has <br />historically had higher disinfection byproducts than other parts of the distribution system; and <br />WHEREAS, on June 25, 2012, the City Commission approved a pilot study which <br />positively proved the effectiveness of using granular activated carbon; and <br />WHEREAS, the design of the required GAC improvements at the South Water <br />Treatment Plant has been completed by Reiss Engineering; and the project is ready for <br />construction; and <br />WHEREAS, Wharton - Smith, Inc. has an Agreement with the City for General <br />Construction Manager at Risk for Projects Less Than $2 Million and has submitted a Guaranteed <br />Maximum Price (GMP) proposal in the amount of $1,799,030 to construct the required GAC <br />treatment addition at the South Water Treatment plant; and <br />WHEREAS, City staff has reviewed Amendment #4 to the Agreement with Wharton - <br />Smith, Inc. and finds it favorable to the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves <br />Amendment #4 with Wharton - Smith, Inc. for an amount not to exceed $1,799,030 and authorizes <br />the Mayor to execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION M. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
