RESOLUTION 11 -2240 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA APPROVING <br />AND AUTHORIZING THE EXECUTION OF A SCOPE OF SERVICES <br />AGREEMENT BETWEEN HDR ENGINEERING, INC. AND THE CITY OF <br />CASSELBERRY FOR CONSTRUCTION ENGINEERING INSPECTION <br />SERVICES FOR THE WIRZ TRAIL SECTION 1 PROJECT, PROVIDING FOR <br />CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." <br />WHEREAS, on January 24, 2011, via Resolution 11 -2223, the City Commission approved a <br />Local Agency Program (LAP) Agreement with the Florida Department of Transportation (FDOT) for <br />obtaining and providing financial reimbursement assistance to the City for construction costs of Wirz <br />Trail Section 1; and <br />WHEREAS, FDOT has submitted an amended LAP Agreement for the Wirz Trail Section 1 <br />project which provides for the actual construction and CEI reimbursements costs of $1,284,158.00; and <br />WHEREAS, FDOT has required that professional construction engineering inspection (CEI) <br />services are necessary to ensure Wirz Trail Section 1 is constructed efficiently and effectively to the <br />City's and FDOT's satisfaction; and <br />WHEREAS, the City has a continuing services contract with HDR to provide professional <br />transportation engineering services which includes CEI services; and <br />WHEREAS, HDR Engineering, Inc. has provided a Scope of Services Agreement for CEI <br />services for the Wirz Park Trail Section 1 project not to exceed $91,367.84, without prior authorization; <br />and <br />WHEREAS, City Staff has reviewed the Scope of Services Agreement for CEI services <br />submitted by HDR Engineering, Inc. and found it adequate to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Scope of <br />Services Agreement with HDR Engineering, Inc. for CEI Services for the Wirz Trail Section 1 project, <br />attached as "Exhibit A "', and authorizes the Mayor to execute said document on behalf of the City. <br />SECTION 1I. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect <br />of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its <br />passage and adoption. <br />
