RESOLUTION 11 -2228 <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF THE AGREEMENT WITH CENTRAL FLORIDA <br />ENVIRONMENTAL CORPORATION FOR THE NORTH WINTER PARK <br />DRIVE PHASE H PROJECT; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, at its October 25, 2010 meeting, the City Commission approved a Local <br />Agency Program agreement with the Florida Department of Transportation for the North Winter <br />Park Drive Phase 11 Project, via Resolution 10 -2194; and <br />WHEREAS, the City of Casselberry received the Notice to Proceed fi-om the FDOT on <br />November 2,2010; and <br />WHEREAS, the City of Casselberry requested proposals from qualified contractors via an <br />advertisement in the Orlando Sentinel on December 19 and 26, 2010 for the North Winter Park <br />Drive Phase II Project; and <br />WHEREAS, on January 18, 2011, the City held a public bid opening where seven (7) sealed <br />bids were received; and <br />WHEREAS, Central Florida Environmental Corporation submitted the lowest responsive, <br />responsible, and adequate bid in the amount of $2,250,749.97 and has experience performing similar <br />work; and <br />WHEREAS, City staff have reviewed the bid proposal from Central Florida Environmental <br />Corporation and finds it adequate to meet the project requirements of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Agreement with Central Florida Environmental Corporation, attached as "Attachment A ", and <br />authorizes the Mayor to execute said document on behalf of the City. <br />SECTION H. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
