RESOLUTION 11-2216 <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF A <br />CONTRACT WITH JAMES A. THOMPSON AND ELIZABETH THOMPSON <br />FOR PURCHASE AND SALE OF A PORTION OF PARCEL 10-21-30-501-0000- <br />35B0; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE <br />DATE." <br />WHEREAS, the City of Casselberry, via Resolution 06-1714, established a policy to surplus and <br />sell City-owned property; and <br />WHEREAS, the City of Casselberry received a request fi•om Mr. James Thompson, property <br />owner at 1428 Lakeshore Drive, to purchase a portion of City-owned Parcel 10-21-30-501-0000-35B0 <br />which is adjacent to his property; and <br />WHEREAS, on December 13, 2010 the City Commission approved Resolution 10-2204 to <br />surplus a portion of Parcel 10-21-30-501-0000-35B0 in order to prepare the site for future sale; and <br />WHEREAS, the purchase price of the 8,275 square foot portion of the property is $4,550 and the <br />Buyer agrees to absorb any and all costs associated with the real estate transaction, including the City's <br />attorney fees; and <br />WHEREAS, the City Attorney and City staff have reviewed the Contract and recommend the <br />purchase and sale of a portion of Parcel 10-21-30-501-0000-35B0. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission hereby approves the Contract (attached as Exhibit A) with <br />James and Elizabeth Thompson for the purchase and sale of a portion of Parcel 10-21-30-501-0000-35B0, <br />and authorizes the Mayor to execute said document on behalf of the City of Casselberry, Florida. <br />SECTION H. Conflicts. All Resolutions orparts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or nnpau the validity, force, or <br />effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date.
