<br />RESOLUTION 08-1893 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF THE FIRST AMENDMENT TO THE COMMUNITY DEVELOPMENT <br />BLOCK GRANT AGREEMENT WITH SEMINOLE COUNTY FOR THE ANCHOR ROAD <br />IMPROVEMENTS PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br /> <br />WHEREAS, the City has determined the need to provide pedestrian, drainage, roadway, and utility <br />enhancements that will serve surrounding low-income areas on Anchor Road; and <br /> <br />WHEREAS, the Anchor Road Improvements Project is ajoint City-County project that includes multiple <br />funding sources, including funding from the City, Seminole County, and Federal Government; and <br /> <br />WHEREAS, in 2007, City staff applied for and was awarded a Community Development Block Grant <br />(CDBG) from Seminole County to assist with the proposed improvements for Anchor Road; and <br /> <br />WHEREAS, the CDBG funds were contingent upon meeting the interim spending milestones for the <br />project; and <br /> <br />WHEREAS, due to the design and permitting schedule for the project, the interim spending milestones <br />are not in line with the project's schedule and, therefore, require modification; and <br /> <br />WHEREAS, Seminole County has submitted the First Amendment to the original agreement which <br />modifies the spending milestones to better suit the design, permitting, and construction schedule for the project; <br />and <br /> <br />WHEREAS, Public Works staff has reviewed the First Amendment to the Community Development <br />Block Grant submitted by Seminole County and has found it to be favorable to the City. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselherry hereby approves the First Amendment to <br />the Community Development Block Grant with Seminole County for the Anchor Road Improvements Project, <br />attached as "Exhibit A", and authorizes the Mayor to execute said document on behalf of the City. <br /> <br />SECTION n. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of <br />this Resolution are hereby repealed. <br /> <br />SECTION m. Severability. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any <br />other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and <br />adoption. <br /> <br />PASSED and ADOPTED this .d5!!2 day of f){::?lk c, -t- .
