<br />RESOLUTION 04-1496 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, TO ENTER INTO AN <br />AGREEMENT FOR LIGHTING SERVICES WITH FLORIDA POWER CORPORATION <br />dba PROGRESS ENERGY FLORIDA, INC.; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry previously requested that FOOT design and install <br />street lighting along SR 436 between Oxford Road and the Seminole/Orange County line and <br />along US Highway 17-92 between Melody Lane and Dog Track Road/Seminola Boulevard; and <br /> <br />WHEREAS, the City of Casselberry is financially responsible for the operation, repair and <br />maintenance of the street lighting systems described above and depicted on the attached map; <br />and <br /> <br />WHEREAS, in accordance with Section 4(c) of the settlement agreement between the two <br />parties, as part of the City's renewed Electric Franchise Agreement dated August 5, 2003, <br />Progress Energy agreed to assume responsibility for maintenance of the street lighting systems <br />described above; and <br /> <br />WHEREAS, City staff has reviewed the Agreement for Lighting Services and found it to be <br />favorable and is pleased with the level of maintenance to the street lighting systems Progress <br />Energy has provided. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Agreement for Lighting Services between the City of Casselberry and Florida Power Corporation <br />dba Progress Energy Florida, Inc. (attached as "Exhibit A"), and authorizes the Mayor to execute <br />said document on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
