<br />RESOLUTION 08-1851 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />ENTER INTO THE "AMENDMENT TO PRE-ANNEXATION <br />AGREEMENT" WITH CRF-MAITLAND, LLC TO ADDRESS BILLBOARD <br />SIGNAGE ON THE PROPERTY LOCATED IN THE CAMBRIDGE OAKS <br />SUBDIVISION, CASSELBERRY, FLORIDA; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry ("City") entered into a Pre-Annexation Agreement ("Agreemenf') <br />with Century Realty Funds, Inc. and The Village Shoppes of Casselberry, Inc. prior to the annexation of <br />property described in Exhibit "D" of that document; and <br /> <br />WHEREAS, Section 4 of the "Agreemenf' enables the billboard on the site to be relocated during <br />construction and the approved site plan indicates the sign to be relocated to the southern area of the property; <br />and <br /> <br />WHEREAS, the billboard was not relocated during construction and remains in the same location on <br />the site; and <br /> <br />WHEREAS, the Pre-Annexation Agreement must be amended to acknowledge the actual location of <br />the billboard and to clarify the intent regarding the lease of the billboard; and <br /> <br />WHEREAS, the City Commission has determined that the amendment to Section 4 of the <br />"Agreemenf' formalizes the City's intent regarding the development of the site and the standing and <br />disposition of the billboard. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission authorizes the Mayor to execute the "Amendment to Pre- <br />Annexation Agreemenf', attached as Exhibit "A". <br /> <br />SECTION II. The City Commission hereby accepts the terms and conditions as presented in said <br />Agreement. <br /> <br />SECTION III. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the proviSions of <br />this Resolution are hereby repealed. <br /> <br />SECTION IV. Severabilitv. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of <br />any other Section or part of this Resolution. <br />
